The slump was driven by concern that rising homeownership and new construction would weaken landlords? power to raise rents as a mammoth share sale flooded the market.

Like the rest of the commercial real estate community, I?ve been captivated by the longstanding Lehman/Equity soap opera and the uncertain future of Archstone Apartments. Over the summer, I hailed Lehman Brothers the winner, since they succeeded (after a protracted legal battle) in wresting the coveted multifamily operator from Equity Residential?s grasp. Just a few months ago, I discussed Lehman?s planned IPO of Archstone, which was meant to capitalize on the well-publicized strength of the multifamily real estate market.

And still, despite Lehman?s former ?victory,? Equity Residential and it?s occasionally foul-mouthed leader have gotten the upper hand, thanks?oddly enough?to declining interest in the multifamily sector. Multifamily has been a top-performing real estate asset for a while now, and a busy development pipeline and already-high rents suggest the sector will soon plateau. Not the best time for an IPO.

Now, Archstone and its nearly 60,000 units are leaving Lehman Brothers? control. Another embarrassment for the Wall Street giant, and a major @#&%ing?win for Sam Zell.

In fairness, though, an IPO is a tricky proposition. More than anything, an IPO requires perfect timing.

Buying and operating an enormous apartment portfolio is one thing; taking that portfolio to the New York Stock Exchange and telling everyone to hold high expectations is another.

This isn?t to say an Archstone IPO under Lehman Brothers? direction would have failed. But in today?s investment climate, where multifamily is like so 2011?,?it?s not advisable to open a public firm under high expectations if it will merely perform adequately. When the public is looking for a blockbuster IPO, adequate isn?t too far removed from ?failed.??With such high stakes, it looks like Lehman Brothers did the right thing by erring on the side of caution.

And who knows? This ongoing saga has had so many surprises already, I?m sure this isn?t the end of the story when it comes to Lehman/Equity/Archstone.

US slams Israel on new settlement plan

WASHINGTON (AP) ? The Obama administration on Monday harshly criticized its top Mideast ally, Israel, over new settlement construction plans in areas the Palestinians claim for a future state and urged it to rethink them.

The White House and State Department said the plans run counter to longstanding U.S. policy, particularly as they relate to a sensitive piece of land outside Jerusalem known as E1.

"We reiterate our long standing opposition to Israeli settlement activity and East Jerusalem construction," White House press secretary Jay Carney told reporters. "We oppose all unilateral actions, including settlement activity and housing construction as they complicate efforts to resume direct, bilateral negotiations and risk prejudging the outcome of those negotiations and this including building in the so called E-1 area."

"We urge Israeli leaders to reconsider these unilateral decisions and exercise restraint as these actions are counterproductive and make it harder to resume direct negotiations to achieve a two state solution," he said.

At the State Department, spokesman Mark Toner said the E1 plans are "especially damaging" to prospects for a resumption in Israeli-Palestinian peace talks.

The E1 area "area is particularly sensitive and construction there would be especially damaging to efforts to achieve a two-state solution," Toner said in a statement.

Israel on Friday announced that it would move ahead on plans to build 3,000 settler homes in the West Bank and east Jerusalem on territory the Palestinians claim as theirs to punish the Palestinians for winning U.N. recognition. It also said it would begin planning work in E1, where construction would essentially end hopes for an eventual Palestinian state to be contiguous.

Building in E1 would sever the link between the West Bank and east Jerusalem, which the Palestinians claim for a future capital. It would also cut off the northern part of the West Bank from its southern flank.

The Palestinians say construction in that territory would kill any hope for establishing a viable state of Palestine. Successive U.S. governments have agreed, and under intense American pressure, Israel has avoided building settlements in the area. It has, however, developed roads and infrastructure and built a police station.

If you buy something on discount and try to return it after the sale or at another store without a receipt, the store has to go by the current price. Target's policies for no receipt returns also come with a small deduction from that current price, but in my case I still ended up with more money than I spent. While this isn't something I recommend taking advantage of, as you're basically taking Target's money, if you lose your receipt on a sale item you should either wait for that sale to pass or return the items to a different store. That way you should at least get what you paid for them instead of incurring a deduction.

New federal health insurance law discussed Tuesday

Attorney and business executive Paula Flowers will discuss the effects of the new federal health care law during a Tuesday meeting in Oak Ridge.

Flowers? presentation, titled??Implications of the New Health Insurance Law for Tennessee,??starts at noon Tuesday?in the Social Hall of the Oak Ridge Unitarian Universalist Church. It?s part of the biweekly Lunch with the League, co-sponsored by the League of Women Voters of Oak Ridge.

Flowers is president of Enovation Group LLC and an attorney with more than 14 years in practice focusing on regulatory and government law and litigation, municipal law, and business and corporate law, a press release said.

She previously served as senior risk adviser to the Oak Ridge National Laboratory and as an environmental compliance engineer for Lockheed Martin Energy Systems at the Y-12 National Security Complex.

Flowers is also a former Tennessee?Commerce and Insurance?commissioner. Appointed by Gov. Phil Bredesen, she served as Tennessee?s insurance and securities regulatory official and served as Tennessee?s state fire marshal, the press release said. She also served on the Tennessee Workers? Compensation Advisory Council, the Tennessee State Insurance Plan Committee, and the Tennessee Health Services Development Agency.

Flowers has bachelor?s and master?s degrees in civil engineering from Tennessee Technological University and McNeese State University, and a law degree, summa cum laude, from the University of Tennessee.
